Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Espresso Dev (Pty) Ltd ("MentionScout", "we", "us" or "our") and govern your access to and use of the MentionScout website and application (the "Service"). Please read them carefully.

1. Acceptance of these terms

By creating an account, starting a trial, or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you are using the Service on behalf of an organisation, you represent that you are authorised to bind that organisation, and "you" refers to that organisation. If you do not agree, do not use the Service.

2. The Service

MentionScout tracks how a brand is mentioned and cited across AI answer engines (such as ChatGPT, Claude, Gemini, Perplexity, Grok, Google AI Overviews and AI Mode), alongside community listening and AI-crawler analytics. We run the prompts you configure against those engines and report mentions, citations, sentiment and related metrics. We may add, change or remove features over time.

3. Eligibility and accounts

You must be at least the age of majority in your jurisdiction and able to form a binding contract. You are responsible for the information you provide, for keeping your login credentials secure, and for all activity under your account. Notify us promptly at [email protected] if you suspect any unauthorised use.

4. Trials, billing and renewals

  • Free trial. Paid plans include a 14-day free trial. A valid payment method is required to start the trial.
  • Auto-conversion and renewal. Unless you cancel before the trial ends, your trial automatically converts to a paid subscription and your payment method is charged. Subscriptions renew automatically each billing period until cancelled.
  • Merchant of Record. Payments are processed by Paddle, which acts as our Merchant of Record and as the seller of record for your purchase. Paddle's terms and privacy notice also apply to the payment transaction. Applicable taxes may be added.
  • Cancellation. You may cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period; you retain access until then.
  • Refunds. If MentionScout is not right for you, you can request a full refund within 14 days of any payment by emailing [email protected]. We will refund that payment to your original payment method through Paddle. You can also cancel at any time from your account settings to stop future charges, and you keep access until the end of the current billing period.
  • Price changes. We may change our prices. We will give you reasonable notice, and changes apply from your next billing period.

5. Acceptable use

You agree not to:

  • Use the Service unlawfully, or to infringe the rights of others or violate the terms of any AI provider.
  • Reverse engineer, scrape, resell or attempt to access the Service or its data other than as permitted.
  • Interfere with, overload or disrupt the Service or any connected systems or networks.
  • Submit content that is unlawful, harmful, or that you do not have the right to submit.
  • Use the Service to build a competing product or to circumvent usage limits.

6. Your data and our license to process it

As between you and us, you own the content you submit to the Service, including your brand names, prompts and competitor configuration ("Customer Data"). You grant us a worldwide, non-exclusive license to host, process, transmit and display Customer Data solely to operate and improve the Service and to provide it to you, including submitting your prompts to the AI answer engines you choose to track. You are responsible for ensuring you have the rights to submit your Customer Data and that doing so does not violate any law or third-party right.

7. AI engine dependency and accuracy

The Service depends on third-party AI answer engines that we do not control. Their outputs are probabilistic and can vary, change or be unavailable without notice. The metrics, scores, mentions, citations and recommendations we report are estimates derived from those outputs and are provided for informational purposes only. We do not guarantee the accuracy, completeness, availability or results of any AI engine or of the Service, and you should not rely on them as the sole basis for business decisions.

8. Warranty disclaimer

The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or secure.

9. Limitation of liability

To the maximum extent permitted by law, MentionScout and its suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amounts you paid us for the Service in the twelve months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

10. Termination

You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if necessary to protect the Service or other users. On termination, your right to use the Service ends. We may delete your Customer Data after a reasonable period, subject to our Privacy Policy and applicable law.

11. Changes to these terms

We may update these Terms from time to time. When we make material changes, we will update the date above and, where appropriate, notify you. Your continued use of the Service after the changes take effect means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of South Africa, without regard to its conflict-of-laws rules. The courts located in South Africa will have exclusive jurisdiction over any dispute, except where applicable law gives you the right to bring proceedings elsewhere.
